1. Introduction

At Mercury Ev-Tech Limited ("Mercury," "we," "us," or "our"), we strive to ensure complete customer satisfaction. This Cancellation & Refund Policy outlines the terms and conditions for cancellations, returns, and refunds related to our electric vehicles, accessories, and services purchased through our website, authorized dealerships, or direct sales channels in India.

2. Booking Cancellation Policy

2.1 Pre-Delivery Cancellations:

  • Customers may cancel their booking before the vehicle is dispatched from our manufacturing facility.
  • Cancellation requests must be submitted in writing via email to support@mercuryevtech.com or through your dealership.
  • Cancellation requests should include your booking reference number, full name, and contact details as provided during booking.

2.2 Booking Amount Refund Timeline:

3. Post-Delivery Returns

3.1 Return Eligibility:

  • Electric Vehicles: Under the Consumer Protection Act, 2019, customers may return their vehicle within 7 days of delivery if it has:
    • Manufacturing defects that significantly impact vehicle performance
    • Damage sustained during shipping (must be reported within 24 hours of delivery)
    • Major discrepancy between advertised specifications and delivered product
  • Accessories and Spare Parts:
    • Must be in original, unused condition with all packaging intact
    • Must be returned within 7 days of delivery
    • Must be accompanied by the original invoice/receipt

3.2 Non-Returnable Items:

  • Customized vehicles with bespoke modifications
  • Vehicles damaged due to accidents, misuse, or negligence
  • Opened or used accessories where packaging seal is broken
  • Batteries that have been activated and used
  • Software subscriptions or digital services once activated

Note: All returns must pass our quality check and inspection process to qualify for refunds or replacements.

4. Refund Process

4.1 Refund Methods:

  • All refunds will be processed to the original payment method used for purchase.
  • For payments made through Razorpay or other online payment gateways, refunds will be initiated to the same account.
  • For cash/cheque payments, refunds will be processed via NEFT/RTGS to the customer's bank account.

4.2 Refund Timeline:

  • Credit/Debit Card Refunds: 7-14 business days after approval
  • UPI/Net Banking: 5-10 business days after approval
  • NEFT/RTGS Transfers: 5-7 business days after approval

4.3 Deductions and Adjustments:

  • Registration charges, insurance costs, and other statutory fees may not be fully refundable as per applicable regulations.
  • For returned vehicles, a usage fee calculated at ₹25 per kilometer driven may be deducted from the refund amount.
  • Any damage beyond normal wear and tear will be assessed, and repair costs may be deducted from the refund.

5. Cancellation of Services

5.1 Scheduled Maintenance:

  • Free if cancelled 24 hours before the appointment.
  • Cancellation within 24 hours may incur a rescheduling fee of ₹250.

5.2 Extended Warranty:

  • Can be cancelled within 30 days of purchase for a full refund.
  • After 30 days, a prorated refund will be provided based on the unused period, minus a processing fee of ₹500.

5.3 Battery Subscription Plans:

  • Monthly plans can be cancelled with 7 days' notice before the next billing cycle.
  • Annual plans are eligible for prorated refunds after completing the first 3 months.

6. Exchange and Replacement

Under specific circumstances, we offer exchange or replacement of vehicles:

  • Manufacturing Defects: If the vehicle has a manufacturing defect that cannot be repaired, we will replace it with an identical model within 30 days of delivery.
  • Serious Performance Issues: If the vehicle consistently fails to meet the range or performance specifications advertised by more than 15% under standard testing conditions, we may offer a replacement after thorough technical evaluation.
  • Accessories and Parts: Defective accessories will be replaced within the warranty period at no additional cost.

7. Force Majeure

Mercury Ev-Tech reserves the right to modify delivery timelines and refund processing periods during circumstances beyond our control, including but not limited to natural disasters, pandemics, labor strikes, governmental actions, or supply chain disruptions. We will communicate any such delays promptly to affected customers.

8. How to Request a Cancellation or Return

To initiate a cancellation or return:

  1. Log in to your Mercury account on our website or visit your dealership
  2. Navigate to "My Orders" section and select the order you wish to cancel
  3. Click on "Request Cancellation" or "Return Product"
  4. Fill in the required details including reason for cancellation/return
  5. Our customer service team will review your request within 48 hours

10. Governing Law

This Cancellation & Refund Policy shall be governed by and construed in accordance with the laws of India. Any disputes arising under this policy shall be subject to the exclusive jurisdiction of the courts in Vadodara, Gujarat, India.
